Legal Notice, Terms of Service & Liability Waiver

Effective Date: April 23,2026

This Legal Notice, Terms of Service, and Liability Waiver (the “Agreement”) governs your access to and use of services provided by Golf Fitters (“the Company,” “we,” “us,” or “our”), including but not limited to custom golf club design, fitting, assembly, repair, retail sales, and golf instruction (collectively, the “Services”).

By purchasing, booking, or participating in any Services, you (the “Client”) acknowledge that you have read, understood, and agree to be legally bound by this Agreement.

1. Assumption of Risk

The Client acknowledges that participation in golf-related activities involves inherent risks, including but not limited to:

• Physical injury from swinging clubs or being struck by golf balls
• Muscle strain, repetitive stress injuries, or aggravation of pre-existing conditions
• Equipment failure or misuse

The Client voluntarily assumes all such risks and accepts full responsibility for any injury, loss, or damage.

2. Release and Waiver of Liability

To the fullest extent permitted under Ontario law, the Client releases and discharges Golf Fitters, its owners, employees, contractors, and affiliates from any claims arising out of or related to:

• Participation in lessons, fittings, or use of facilities
• Use or performance of any golf equipment sold, fitted, or repaired
• Instruction, advice, or recommendations provided

This applies regardless of negligence, except where prohibited by law.

3. Limitation of Liability

The total liability of Golf Fitters shall be limited to the amount paid by the Client for the specific Service or product.

Under no circumstances shall the Company be liable for indirect, incidental, or consequential damages, including loss of income or use.

4. No Guarantee of Results

Golf Fitters makes no guarantees regarding performance improvement, equipment effectiveness, or durability beyond manufacturer specifications.

5. Custom Orders & Equipment

• All specifications must be approved prior to order
• Minor manufacturing variations may occur
• All custom orders are final sale and non-refundable except as required by law

Manufacturer warranties apply where applicable.

6. Indemnification

The Client agrees to indemnify and hold harmless Golf Fitters from any claims, damages, or legal costs arising from their use of Services or breach of this Agreement.

7. Medical Fitness

The Client confirms they are physically capable of participating. The Company is not responsible for assessing medical fitness.

8. Cancellations & Payments

• Deposits are non-refundable
• 24-hour notice required for lesson cancellations
• No-shows may be charged in full

9. Third-Party Products

Third-party products are subject to manufacturer warranties only. All other warranties are disclaimed to the extent permitted by law.

10. Governing Law

This Agreement is governed by the laws of Ontario and applicable Canadian law. Disputes shall be resolved in Ontario courts.

11. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

12. Acknowledgment

By using the Services of Golf Fitters, the Client acknowledges and agrees to this Agreement and understands it limits their legal rights.
